This Privacy Policy explains how R and SK Singh Enterprises Private Limited, trading as Atey Sarees (“Atey”, “we”, “us” or “our”), collects, uses, shares, retains and protects personal data when you visit atey.in, purchase from us online or in person, create or use a customer account, select a service such as Ready-to-Wear, submit a review, contact us, or otherwise interact with Atey.

Atey is the primary data fiduciary or controller for the personal data described in this Policy, except where a third-party service provider acts as an independent data fiduciary or controller for its own processing. We handle personal data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023 and the rules made under it, as and when their provisions apply.

1. Scope of this Policy

This Policy applies to personal data collected through:

  • our website, online store and Shopify checkout;
  • Atey customer accounts and permitted social sign-in options;
  • online and in-person orders, including Shopify POS transactions;
  • Ready-to-Wear, Fall & Pico, gift wrap and other service requests;
  • email, telephone, WhatsApp, social media and customer-support communications;
  • review forms, feedback forms, uploaded photographs and other customer submissions; and
  • cookies, analytics and similar technologies used on atey.in.

This Policy does not govern a third party’s own website, application or service, even when it is linked from Atey. Those parties process data under their own terms and privacy notices.

2. Personal Data We Collect

Depending on how you interact with Atey, we may collect the following categories of personal data.

2.1 Identity and contact information

  • name;
  • email address;
  • mobile or telephone number;
  • billing, delivery and pickup address;
  • country, state, city and postal code; and
  • details of a gift recipient when you ask us to send a gift or gift card.

2.2 Account and authentication information

  • customer-account details and account preferences;
  • login and authentication information;
  • account identifiers received from a permitted social sign-in provider, such as Google or Meta, when that option is available and you choose to use it; and
  • records relating to account access, authentication and security.

We do not receive the password that you use with an independent social sign-in provider. The information received depends on the permissions you approve with that provider.

2.3 Order, transaction and delivery information

  • products and services purchased, viewed, saved or added to cart;
  • order number, invoice information, prices, discounts, taxes and transaction status;
  • payment method type and payment confirmation information;
  • delivery, courier, tracking, pickup, return, exchange and refund information;
  • fraud-prevention and transaction-risk signals; and
  • records of online or in-person sales and related customer service.

2.4 Ready-to-Wear measurements and service instructions

When you select Atey’s Ready-to-Wear service, we may collect measurements and preparation preferences such as waist, hip, height, footwear height, preferred drape height and special instructions.

We use this information to prepare the selected saree, clarify the requested service, provide related support and maintain necessary order records. We do not use Ready-to-Wear measurements for medical assessment or health profiling.

2.5 Payment information

Payments may be processed through Shopify checkout, Razorpay or another payment provider enabled by Atey. Payment providers may collect card, bank, UPI, wallet, authentication, device and transaction information directly from you.

Atey does not ordinarily receive or store your complete card number, CVV, UPI PIN, internet banking password or other confidential payment credential. We may receive limited payment information such as the payment method type, transaction reference, payment status and information necessary for reconciliation, refunds, fraud prevention and customer support.

2.6 Communications, reviews and customer content

  • emails, WhatsApp messages, telephone conversations and support enquiries;
  • feedback, survey responses and complaint details;
  • review title, rating, review text and product information;
  • order details submitted to verify a purchase; and
  • photographs, files or other content that you voluntarily upload or send to us.

Approved reviews, names or initials, ratings and photographs may be displayed publicly on atey.in or Atey’s marketing channels as explained at the time of submission. Please do not submit content containing personal information that you do not want made public.

2.7 Device, usage and technical information

When you browse or use atey.in, we and our service providers may automatically collect:

  • IP address and approximate location derived from it;
  • browser, operating system and device type;
  • device identifiers, session identifiers and cookie identifiers;
  • pages viewed, links selected, search activity, referral source and time spent;
  • cart, checkout and interaction events; and
  • security logs, error reports and diagnostic information.

2.8 Marketing preferences

We may record whether you have subscribed to or opted out of promotional email, SMS, WhatsApp or other marketing communications, together with information needed to respect that choice.

3. How We Collect Personal Data

We collect personal data:

  • directly from you, including when you place an order, create an account, submit measurements, contact us or complete a form;
  • automatically, through cookies, pixels, logs and similar technologies when you use atey.in;
  • from our service providers, including Shopify, payment providers, delivery partners, authentication providers and customer-support tools;
  • from social platforms, when you interact with Atey or choose an available social sign-in feature; and
  • from lawful public or business sources, where appropriate for fraud prevention, legal compliance or business verification.

4. Why We Use Personal Data

We may use personal data to:

  • operate, maintain and secure atey.in;
  • create and manage customer accounts;
  • process payments and confirm transactions;
  • accept, prepare, fulfil, deliver, track and support orders;
  • provide Ready-to-Wear and other selected services;
  • contact you when measurements, delivery details or order instructions need clarification;
  • send order confirmations, invoices, receipts and delivery updates;
  • handle returns, exchanges, refunds, complaints and customer enquiries;
  • verify purchases and moderate customer reviews;
  • prevent fraud, misuse, unauthorised access and other security incidents;
  • maintain accounting, tax, audit, corporate and transaction records;
  • comply with applicable law, court orders and lawful government requests;
  • analyse store performance and improve our products, services, website and customer experience;
  • personalise content and recommendations where permitted;
  • send marketing communications when you have consented or when otherwise permitted by law; and
  • establish, exercise or defend legal claims.

Where applicable law requires a lawful basis, we rely on your consent, steps taken at your request, performance of a contract, compliance with legal obligations, protection of our systems and customers, or other lawful grounds available under applicable law.

5. Cookies and Similar Technologies

Atey and our service providers use cookies, pixels, local storage and similar technologies to operate the store and understand how it is used. These technologies may include:

  • strictly necessary technologies used for security, account access, cart, checkout, payment and core website functions;
  • functional technologies used to remember settings and improve convenience;
  • performance and analytics technologies used to understand traffic, errors and website performance; and
  • advertising technologies used, where enabled and permitted, to measure campaigns or present more relevant advertising.

Where required, you can accept, reject or manage non-essential technologies through the cookie or privacy controls displayed on atey.in. You can also adjust browser settings, but blocking necessary cookies may prevent the cart, account or checkout from functioning properly.

6. Marketing Communications

We send promotional messages only where we have the required permission or another lawful basis. You can unsubscribe from marketing email by using the unsubscribe link in the message. You may also ask us to stop marketing through the same channel in which you received it or by contacting us.

Even after you opt out of marketing, we may continue to send essential non-promotional communications about an order, payment, delivery, account, security matter or customer-service request.

7. How We Share Personal Data

We share personal data only where reasonably necessary for the purposes described in this Policy, including with the following categories of recipients.

7.1 Shopify

Our online store, customer accounts, checkout and certain store functions are provided through Shopify. Shopify processes customer and merchant data to provide, secure and improve its platform and related services. Shopify may process data in countries other than the country in which you live.

7.2 Payment providers

We share transaction information with Razorpay, Shopify-supported payment services, banks, card networks, UPI participants, wallet providers and fraud-prevention services as necessary to process, authenticate, settle, reconcile, refund and secure payments.

7.3 Delivery and fulfilment partners

We may share your name, address, phone number, order information and delivery instructions with courier, logistics, local-delivery, pickup and fulfilment partners.

7.4 Service and preparation personnel

Ready-to-Wear measurements, service instructions and relevant order details may be made available to authorised personnel who prepare, finish, check or pack the selected saree. Access is limited to what is reasonably necessary to perform the service.

7.5 Technology, communication and authentication providers

We may use providers for website hosting, email, WhatsApp or messaging, customer support, account authentication, file storage, review collection, analytics, security and fraud prevention. If you choose social sign-in, the relevant provider may process information under its own privacy policy.

7.6 Analytics and advertising partners

Where enabled and permitted, limited device, cookie, browsing, purchase or campaign information may be shared with analytics and advertising providers to measure performance, understand customer journeys and improve promotions. Where applicable law treats this activity as a “sale” or “sharing” of personal data, we will provide any required notice or choice.

7.7 Professional advisers and authorities

We may share data with accountants, auditors, insurers, banks, legal advisers, regulators, law-enforcement bodies, courts or government authorities where reasonably necessary or legally required.

7.8 Business changes

Personal data may be disclosed as part of a merger, financing, restructuring, sale of assets, insolvency process or transfer of all or part of our business, subject to applicable confidentiality and legal requirements.

We do not sell personal data for monetary consideration.

8. International Processing and Transfers

Some service providers, including ecommerce, cloud, authentication, analytics, communication and payment providers, may process personal data outside India or outside your home country. Where required, we use contractual, organisational or other safeguards and comply with applicable restrictions on cross-border processing.

9. Data Retention

We retain personal data only for as long as reasonably necessary for the purpose for which it was collected, including to:

  • complete and support an order or service;
  • maintain an active customer account;
  • respect marketing and privacy preferences;
  • maintain legally required tax, accounting, invoice and transaction records;
  • resolve disputes, prevent fraud and enforce agreements; and
  • meet legal, regulatory, audit and security obligations.

Retention periods vary according to the type of data and the reason for processing. Ready-to-Wear measurements are retained only for as long as reasonably needed to prepare and support the relevant order, maintain necessary records, resolve a dispute or comply with law. We may delete, anonymise or aggregate data when it is no longer required.

10. Data Security

We use reasonable technical and organisational safeguards designed to protect personal data from unauthorised access, loss, misuse, alteration or disclosure. These safeguards may include access controls, secure platforms, authentication, staff restrictions, contractual protections, monitoring and appropriate record-management practices.

No website, internet transmission or storage system is completely secure. You are responsible for protecting your account credentials and should contact us promptly if you suspect unauthorised use of your account or personal data.

If a personal-data breach occurs, we will take appropriate steps and provide notices to affected individuals or authorities where required by applicable law.

11. Your Privacy Rights and Choices

Depending on the law that applies to you, you may have the right to:

  • request information about the personal data we process and how it is used;
  • request access to a summary or copy of eligible personal data;
  • correct, complete or update inaccurate or incomplete personal data;
  • request deletion or erasure, subject to lawful retention requirements;
  • withdraw consent where processing is based on consent;
  • opt out of promotional communications;
  • raise a grievance regarding our processing of personal data;
  • request information about relevant categories of recipients; and
  • nominate another individual to exercise rights in circumstances recognised by applicable law.

To submit a request, email care@atey.in with the subject Privacy Request. Please describe the request and provide enough information for us to identify the relevant account, order or interaction.

We may need to verify your identity before completing a request. We may refuse, limit or delay a request where permitted or required by law, including where data must be retained for an active order, tax record, legal obligation, fraud prevention, dispute or legal claim.

Withdrawing consent does not affect processing that occurred before withdrawal and does not prevent us from processing data that remains necessary to complete an order already placed, comply with law or exercise legal rights.

12. Children’s Privacy

Atey’s store is intended for adults. A person under 18 should use the store or place an order only with the involvement and consent of a parent or lawful guardian. We do not knowingly direct behavioural advertising to children or intentionally collect a child’s personal data without appropriate authorisation.

If you believe that a child has provided personal data without the necessary consent, contact us so that we can review and take appropriate action.

13. Third-Party Websites and Services

atey.in may contain links to third-party websites, social platforms, payment pages, maps or other services. Atey is not responsible for the privacy practices, security or content of an independent third party. Review the privacy notice of the relevant service before providing information.

14. Changes to this Privacy Policy

We may update this Policy to reflect changes in our services, technology, providers, business practices or legal obligations. The revised version will be posted on atey.in with a new “Last updated” date. Where required, we will provide additional notice or obtain consent for material changes.
